HOTEL BOOKING CONDITIONS

1. Definitions - The 'Agent' means The Small Hotel Company Limited, which is acting for the individual Hotel. The 'Client', who is the person named on the Booking Form and on whose behalf the booking is made, is invited to enter into a contract with the Hotel, i.e. the Clients contract is with the Hotel. These conditions are subject to the English Law and it is a requirement that you read these conditions before making a booking.

2. Booking - Once a provisional hotel booking has been made, the appropriate deposits or full payment, should be received by the agent within 3 days. Only after written confirmation has been sent by the Hotel will the booking of accommodation become confirmed.

3. Terms of Payment - The deposit is non-refundable and the balance of the payment must be received by the Agent not less that 4 weeks before the date of arrival. The hotel reserves the right to regard the booking as cancelled if the balance of the payment remains unpaid after the due date, and shall be entitled to retain any deposit paid. For bookings made less than 4 weeks prior to arrival date, payment in full is required.

4. Prices - The rates quoted are in Euros with a sterling equivalent shown based on the rate of exchange of 1.5€ = £1. This sterling equivalent is given for guidance only. The exact sterling price to be paid shall be determined at the rate of exchange on the day of payments of the deposit, balance or full payment.

5. Cancellation by the Client - Any cancellation must be received in writing. Cancellation of accommodation will apply from the date of receipt by the Agent of the written cancellation advice. The following charges will apply:

- Cancellation more than 30 days prior to arrival - Loss of Deposit

- Cancellation between 15 and 30 days prior to arrival - 50% of the total cost of the booking

- Cancellation between 1 and 15 days prior to arrival or no show - 100%

6. Information - We make every effort to ensure that descriptions relating to the hotels are accurately reproduced. It is possible however, that changes in facilities may occur without our knowledge. We will endeavour to communicate any such changes, but cannot be held responsible for resulting inaccuracies which are beyond our control. The Agent therefore shall not be liable in the event that any aspect of the holiday fails for reasons outside its reasonable control. All distances and measurements given are approximate and should be used as a guide only.

7. Complaints - It should be noted that the Agent is acting only to arrange the booking on behalf of the Hotel and does not accept responsibility of the accommodation. If during the course of the holiday the Client has any reason for complaint or dissatisfaction he/she should first contact the Hotel in order that remedial action may be taken. If, after that, the Client feels that the problem has not be resolved, the Client should, within 7 days of returning from the holiday, put his/her comments in writing to the Agent, who will do its best to help resolve any justifiable complaint with the Hotel. We cannot entertain any complaints if the above procedures have not been complied with.

8. These conditions are subject to English Law and the English Courts shall have sole jurisdiction.

FINCA RENTAL

1. Booking – Once a provisional booking has been made, the appropriate deposit or full payment should be received by the Agent (known as The Small Hotel Company), within 3 days . Written confirmation will act as acceptance of booking.

2. Terms of Payment – The non-refundable deposit of 30% of the total rental is required on booking. The balance will be due to the Agent no later than 6 weeks prior to arrival, otherwise cancellation may be presumed and cancellation charges will then take effect. All prices are quoted in Euros with a sterling equivalent shown based on the rate of exchange £1 = 1.5€. This is given for guidance only. The exact sterling price to be paid shall be determined at the rate of exchange on the day of payments of the deposit, balance or full payment.

3. Cancellation by the Client – Any cancellation must be made in writing and will apply from the date the letter is received by the Agent. The following charges will apply:

Cancellation more than 30 days prior to arrival – Loss of deposit
Cancellation within 30 days of arrival – 100%

4. Information - We make every effort to ensure that descriptions relating the fincas are accurately described. However, The Small Hotel Company is acting as an agent in the UK for the private owners or their representatives and will not be liable for any changes made to the property that have not been advised to the Agent. All distances and measurements given are approximate and should be used as a guide only. The owners reserve the right to visit the property at any time to undertake essential maintenance work, pool cleaning and gardening.
The Agent shall not be liable for any loss or damage arising from any matter outside the reasonable control of the Agent, including Acts of God, War, Civic Disturbances, strikes or other industrial Action or failure of public supplies.
All properties are privately owned and as such The Small Hotel Company does not accept any liability for death, personal injury, loss, damage or inconvenience arising from the provision of these holidays where due to the neglect, act of omission of any other company, or individual or the employees or agents thereof.

5. Complaints – It should be noted that the Agent is acting only to arrange the booking on behalf of the property owner and does not accept responsibility of the accommodation. The Agent will not be responsible for any breakdown of public services including water and electricity. The electricity and water supply is often not as reliable as in the UK. In case of any breakdown in the property, please notify the owner/keyholder whose details will be found in the property. If during the course of the holiday the Client has any reason for complaint or dissatisfaction, the Client should first contact the owner or keyholder in order that remedial action may be taken. If, after that, the Client feels that the problem has not been resolved, the Client should, within 7 days of returning from the holiday, put his/her comments in writing to the Agent, who will do its best to help resolve any justifiable complaint. We cannot entertain any complaints if the above procedures have not been adhered to.
